These terms govern your use of softcourtservices.com, which is operated by Anthony Lopez, doing business as Soft Court Services ("we", "us"). By using the site, you agree to them. If you do not agree, please do not use the site.

What this site is for

The site describes the clay tennis court construction, renovation and maintenance services we offer. Everything on it is general information. It is not professional advice about your particular court, which depends on its site, age, location, use and condition.

No offer, quote or contract

Nothing on this site is an offer, a quote, a price or a guarantee. We provide services under a separate proposal or agreement for each project. If that agreement and these terms ever conflict, the agreement controls.

Sending us a message through the site does not create a contract or a client relationship.

Illustrations, photos and descriptions

The 3D court model and any diagrams on this site are simplified illustrations. They are not construction drawings, and the actual layout, materials, dimensions and components of a court vary from project to project.

Some photos show courts we have built or maintained. Others are stock images used for illustration and do not show our projects. Figures about performance, such as water use, are general descriptions of the system, not guarantees for any particular court. Testimonials reflect the experience of the individual clients who gave them, and your results may differ.

We try to keep the site accurate and current, but we do not promise that every detail is complete or up to date, and we may change the site at any time without notice.

Our content

The material on this site is owned by Soft Court Services or used with permission from its owners, and is protected by copyright and other laws. You may view the site and print pages for your own personal, non-commercial use. You may not copy, republish, sell or create derivative works from any part of it without our written permission.

HydroCourt is a trademark of Soft Court Services. Har-Tru and other product and company names mentioned on the site are the trademarks of their respective owners. Mentioning them does not imply that any owner endorses this site, except where we say so.

Using the site

You agree not to:

  • Use the site for anything unlawful, or in a way that could harm us or anyone else
  • Try to gain access to parts of the site, its systems or its data that are not meant for the public

Limitation of liability

To the fullest extent the law allows, Soft Court Services will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising from your use of the site or your inability to use it. Our total liability for any claim arising from your use of the site is limited to one hundred US dollars ($100).

Some jurisdictions do not allow certain warranties to be excluded or liability to be limited, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

Indemnity

To the extent the law allows, if you use the site unlawfully or break these terms, you agree to cover the claims, losses and reasonable legal costs we incur as a result.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute about the site or these terms will be heard in the state courts in Santa Barbara County, California, or, where a federal court has jurisdiction, in the United States District Court for the Central District of California, and you agree to those courts' jurisdiction.

We may update these terms from time to time. The date at the top of this page shows when they last changed. Using the site after a change means you accept the updated terms.

General

If any part of these terms is found unenforceable, the rest remains in effect. If we do not enforce a term, that is not a waiver of our right to enforce it later. These terms, together with our Privacy policy, are the whole agreement between you and us about your use of the site.
